Publication duties
The principal accountable person must prepare a residents engagement strategy for each occupied higher-risk building. Give a copy to every resident aged 16 or over and to every unit owner. Consult for at least 3 weeks after the first issue. Consult again after a revision, unless it follows a consultation. Review the strategy at least every 2 years.
A reference note from Dan Malone, who builds software products.
The rule
“Each consultation period must last at least 3 weeks but can be longer.”
The facts
| Field | Value |
|---|---|
| Who must act | Section 91(1)(a) of the Building Safety Act 2022 requires a residents' engagement strategy. The principal accountable person prepares it as soon as reasonably practicable. Source |
| Required contents | Section 91(3) sets four required contents. These are the information given to residents, the aspects residents are consulted about, and the arrangements to get views. The fourth is the review of methods. Source |
| Who gets a copy | Section 91(4) requires a copy for every resident aged 16 or over. Every owner of a residential unit also gets a copy. Source |
| Review clock | Regulation 10(1) of SI 2023/907 requires a review at least every 2 years. A review also follows a mandatory occurrence report or significant material alterations. Source |
| Consultation and review records | GOV.UK guidance states that each consultation period must last at least 3 weeks. Consultation follows the first issue and a revision, unless the revision comes from a consultation. The principal accountable person must record each review, whether or not the strategy changes. Source |
| Which buildings | A high-rise residential building has at least 7 storeys or 18 metres of height. It also has at least 2 residential units. Source |
| Submission to the regulator | The principal accountable person must submit a copy of the strategy. This happens when the regulator tells the principal accountable person to apply for a building assessment certificate. Source |
| Answering resident requests | Section 92(2) requires the accountable person to give the information or document as soon as reasonably practicable. Source |
| Form of the answer | Regulation 11 requires a written form residents can understand. Where reasonable, it needs explanations of technical language or plain English summaries. Source |
| Complaints policy | Regulation 12(2) requires a published complaints policy. It must give the address, telephone number and email address of the regulator. Source |
| Enforcement and penalty | Under section 99, the regulator may give a compliance notice. Contravention without reasonable excuse is an offence. On conviction on indictment it carries up to 2 years in prison, a fine, or both. Source |
| Safety documents for residents | Accountable persons must give residents a summary of the most recent fire risk assessment. They must also give a summary of the safety case report. Source |
The artefact
What goes wrong
/01
The strategy goes up once and then nobody reviews it. The 2-year date passes with no record of a review.
/02
The consultation window is shorter than 3 weeks, or the page gives no start and end dates.
/03
The contact block names a managing agent mailbox. It gives no telephone number and no postal address for the principal accountable person.
/04
A revision goes out with no version number and no date. Residents cannot tell which version applies to them.
/05
The page is a PDF only. Screen readers, large text and translation are not available.
/06
One group housing portal covers many buildings. A resident cannot find the strategy for their own building.
/07
The fire risk assessment summary links to a dead file after a change of supplier.
/08
The complaints link sends residents to a general repairs form, with no route to the regulator.
